My Medical Diagnosis is Included in Social Security’s Book of Listings - Does that Guarantee a Win?
Social Security has identified dozens of medical conditions that likely result in a finding of disability. If your diagnosis is referenced in SSA’s Blue Book of Listings, doesn’t that mean that you are guaranteed a win?
As I discuss in this video, if your medical condition included in the Listings (see https://www.meetalisting.com) that is a good thing. In its listings, Social Security has identified 14 body systems and within each of these 14 listings, you will find dozens of specific diagnoses.
If your diagnosis is included in a listing, you know that Social Security considers your medical problem as legitimate and potentially disabling. If your diagnosis is not mentioned at any listing, you can still win, but you will need more medical and non-medical evidence to prevail.
However, you do not automatically win just because your medical diagnosis is referenced in a listing. If you look closely at each listing you will see that there is typically wording that references the vocational impact of your medical problem.
For example, listing 1.04 discusses a herniated disc but it also includes a requirement that you no longer have the capacity to walk effectively, or that you have loss of reflexes, or that you have to constantly change position.
In this example, you won’t win just because you have a herniated disc, unless you can show that the effect of that herniated disc has been to limit you from moving, or has resulted in severe, unmanageable pain. And you prove these functional limitations with medical records and functional capacity opinion evidence from your doctor. #socialsecuritylistings #qualifyfordisability #SSDIevidence
