I previously tried to unravel Samantha's defamation suit against Meghan, the Duchess, of Sussex. It came down to Samantha trying prove Meghan "defamed," her sister Meghan, the Duchess of Sussex, when Meghan spoke to Oprah in her childhood. However, Samantha claimed Finding Freedom defamed Meghan, but Meghan didn't write or publish Finding Freedom. It looked as though the case was dragging its feet through Florida's civil courts. The Duke and Duchess might even have to be deposed for this nuisance lawsuit. The judge dismissed the case on Thursday. After a Florida judge granted a motion for dismissal, Samantha Markle lost her defamation lawsuit against her half-sister, Meghan Markle. Samantha filed her case against Meghan Markle in March 2022. She sued Meghan Markle for defamation, injurious falsehoods, and "malicious lies" in several alleged instances. This included during Oprah Winfrey's well-publicized sit down interview with Harry. U.S. District Judge Charlene E. Edwards Honeywell granted Meghan's motion for dismissal on Thursday after Samantha claimed that the couple's relationship was "unravelled" because of Samantha's star rise and her eventual meeting with Prince Harry. Samantha's lawsuit cites three issues from Oprah 2021 interview. In that interview Meghan claimed she was an only child, that she had only met her half sister "a handful" and that Samantha changed her surname after Meghan began dating Prince Harry to cash in on her fame. "A reasonable listener wouldn't think that Defendant was suggesting she has no half siblings, that Plaintiff doesn't actually exist or that Plaintiff was not related to her," the ruling states regarding Meghan's claim that she was an "only" child to Oprah. "As a normal listener would understand, Defendant merely exprimes her opinion about her childhood as well as her relationship with her half siblings. The Court concludes that Defendant’s statement cannot be objectively verified or subject to empirical evidence . The statement cannot be proved false because it isn't 'capable' of being proven false and is therefore protected from defamation actions. Samantha claimed that Meghan had told Oprah they only had met "a handful" of times. But the court denied that claim. Samantha's claim that she changed her surname to be famous was also dismissed. Samantha said the transcript clearly contradicts the claims. She noted that Meghan had stated the following: "She changed back her last name to Markle. I believe she's in her early 40s at the time. This is when I began dating Harry. That's enough, I believe. Samantha was able to file an amended complaint within 14 day of the order, but the claims were denied without prejudice. Samantha also claims her half-sister "contributed falsified information" to the authors of Finding Freedom: Harry, Meghan and the Making of a Modern Royal Family. This is specifically Chapter 12, titled "A Problem Like Samantha." The court however agreed with Meghan. "Defendant argues the claims based upon Finding Freedom must fail since she didn't publish the book," it reads. "The Court agrees." Samantha's request to have attorneys' fees and costs incurred under the anti-SLAPP statute denied by the court without prejudice.
