We're talking about the FBI's warrantless use of “backdoor searches” of the vast Section 702 database of information that contains emails, texts and phone calls. The FBI’s ongoing misuse of section 702 information was so ”persistent and widespread” that the FISA Court said it might become necessary to limit the FBI’s access. To make matters worse, the FBI is the only intelligence agency that can search for evidence of a crime - in addition to searching for foreign intelligence like the other agencies. This is an extraordinarily wide, and dangerous, allowance for an already politicized FBI. Notably, the FBI was recently cited by the FISA court for illegally using section 702 surveillance to collect information on individuals associated with events on January 6th. As house intelligence chair Mike Turner stated, “the FBI is absolutely the problem child in FISA and 702. The abuses are abhorrent.
