Stuttgart Arkansas Police Department Officer Stewart DWI July 29th 2023

On Saturday, July 29th, 2023, I, Ptl. Stewart was patrolling heading west on 2nd and Main coming up on 2nd and Lowe over the train tracks when I observed a maroon Cadillac. The maroon Cadillac failed to yield and made a wide turn almost going into the ditch on the opposite side of the road,
when correcting itself the vehicle stayed left to center. Once making it to the stop sign at 2nd and Buerkle I, Ptl, Stewart activated my blue lights and initiated a traffic stop. The vehicle proceeded and made a complete stop at the residence of 2000 South Henderson Street. I, Ptl. Stewart read the license plate to dispatch reading "AKD 97A". Dispatch gave me the read back stating that was 1992 Cadillac Elder ado, maroon in color, returning to a RicQuez Hampton and no proof of insurance. Contact was then made with the driver and his drivers license was then asked for, the driver informed me that he was suspended and didn't have his drivers license with him at the time. His name was then asked for and I informed dispatch to run a RicQuez Hampton. Dispatch informed me that Mr. Hampton had warrants out of England and Monroe County, Suspended, and was a parolee with a search wavier on file. At this time I, Ptl. Stewart advised Mr. Hampton of this information and asked him to exit the vehicle. Ptl. Johnson then informed dispatch to see what England and Monroe county advise us to do with the outstanding warrants and conducted a search of the vehicle. I, Ptl. Stewart began a search on Mr. Hampton person, no findings were collected at the time. I, Ptl. Stewart then advised to Mr. Hampton that there was an odor of intoxication and was asked had he been drinking. Mr. Hampton stated that he hadn't had anything to drink recently and that smell was the previous night. At this time Deputy Leech conducted a Preliminary Test. At the time Mr. Hampton refused and said that he hadn't been drinking. I, Ptl. Stewart advised that he could take the Standard Field Sobriety Test, which is 3 test conducted, "Horizontal Gaze Nystagmus", "Walk and Turn", and the "One Leg Stand". Mr. Hampton conducted a Preliminary Test at this time conducted by Deputy Leech. Mr. Hampton blew a .12. I, Ptl. Stewart then conducted the Standard Field Sobriety Test. Mr. Hampton was asked of any medical problems that needed to be known, he stated that he had been shot in the leg a few years ago, i then asked did he wear glasses or contacts, he stated no and that he's done these test before and was ready to began the test. The first test began which was the "Horizontal Gaze Nystagmus", Mr. Hampton was advised to follow the tip of my finger with only his eyes and not to turn his head, place and leave his hands down to his side and to place his feet together, the test began.
