Washington Gun Law President, William Kirk, discusses a recent advanced publication of a Stanford Law Review article which attempts to tackle the issue as to how government attorneys can deal with the fact that almost all "historical analogues" necessary to justify a gun control law under the Bruen test will, in almost all instances, be rooted in racism. Does this mean that the government attorneys must embrace these horrific laws? Does it mean that they must denounce these laws? Or, is there another option?
