वरिष्ठ अधिवक्ता कौन होता है ?
[ Who is a Senior Advocate ? ]

उत्तर - अधिवक्ता अधिनियम , 1961 की धारा 16 ( 1 ) के अनुसार अधिवक्ताओं के दो वर्ग हैं- वरिष्ठ अधिवक्ता एवं अन्य अधिवक्ता
धारा 16 ( 2 ) के अनुसार वरिष्ठ अधिवक्ता ऐसा व्यक्ति होता है जो उच्च न्यायालय या उच्चतम न्यायालय की राय अपनी योग्यता , विधि व्यवसायी वर्ग में विधि व्यवसाय काल या विधि विषयक विशेष ज्ञान या अनुभव के आधार पर ऐसे सम्मान का पात्र होता है ।
देवेश राय बनाम हाईकोर्ट ऑफ कलकत्ता ( ए.आई.आर. 2019 कलकत्ता 77 ) के मामले में वरिष्ठ अधिवक्ता के लिए निम्नांकित तीन बातें आवश्यक बताई गई हैं •
( i ) विधि का विशेष ज्ञान ,
( ii ) अनुभव एवं
( iii ) बार में कार्य करने की अवधि ( Standing at Bar ) ।
वरिष्ठ अधिवक्ताओं के लिए " वरिष्ठ अधिवक्ता पदनाम नियम , 1999 " ( Designation of Senior Advocates Rules ) बनाए गए हैं । डेमोक्रेटिक बार एसोसिएशन , इलाहाबाद बनाम हाईकोर्ट ऑफ जूडिकेचर एट इलाहाबाद ' ( ए.आई.आर. 2000 इलाहाबाद 300 ) के मामले में इन नियमों को संवैधानिक माना गया है ।
उच्च न्यायालय द्वारा किसी अधिवक्ता को वरिष्ठ अधिवक्ता के रूप में पदाभिहित कियाजा सकता है , चाहे तत्सम्बन्धी नियम नहीं भी बन पाये हों । ( एम . वीरभद्रेय्या बनाम यूनियन ऑफ इण्डिया , ए.आई.आर. 2016 एन.ओ.सी. 427 कर्नाटक ) of right . ]
यहाँ यह उल्लेखनीय है कि कोई भी अधिवक्ता अपने आपको वरिष्ठ अधिवक्ता घोषित करने का एक अधिकार के रूप में दावा नहीं कर सकता है । [ Declaration as Senior Advocate can not be claimed as a matter केरल , 105 ]
