Allain Albert and Janice Butler of Bathurst New Brunswick were charged for Mischief for not wearing a mask to pay at a gas station.
The attendant escalated the situation and claimed they were refusing the pay for their gas. They were charged with mischief, HOWEVER, the attendant admitted during trial that HE didn't want them paying if they weren't wearing a mask. Furthermore, no accommodation was offered for them to pay. The provincial mandates offered to provisions; 1. an exemption from wearing a mask, with no proof required and 2. accommodation for those who do not wear a mask. Neither was offered to the couple.

They originally had a lawyer, however, when the lawyer refused to argue their rights they decided to do self-representation at the last minute. They never could have imagined what the judge had in store for them.

Allain and Janice were convicted. Janice has been sentenced to 45 days in jail and Albert served 5 days and 40 days on house arrest. This means that Allain and Janice have been cut off from seeing each other for 45 days. This is a complete miscarriage of justice.
