The Circuit Court has disqualified Kim Gardner from the case against McCloskeys

The McCloskeys were charged by Gardner's office after they were seen pointing guns outside their home in the Central West End last month. The McCloskeys were indicted on one count each of unlawful use of a weapon for pointing guns at protestors June 28 McCloskey posted on his Twitter timeline, “The Circuit Court has disqualified Kim Gardner and the entire St. Louis Circuit Attorney’s office from the case against me. We will ask the Judge in Patty’s case to do the same. One court watcher reacted to the news and wrote, “#StLouis ethically challenged Circuit Attorney #KimGardner dismissed from McCloskey case by judge after she used the case for fundraising. Gardner was first elected because of massive financial support from George Soros.” The attorney for the McCloskeys alleges that Gardener's campaign received $41,017.05 in donations during a three-month quarter that encompassed the campaign emails. During previous reports, Gardner's campaign reportedly received $34,459 in donations. In the fundraising emails Gardner sent during her re-election campaign mentioned the McCloskeys. They were used as a reference in her call to action for donations. Garnder's officer discounts the allegations. The judge, Clark, said, “"In fact, the case law and Rules of Professional Conduct prohibit it.” The ruling means Gardner can no longer oversee McCloskey's prosecution. Instead, a special prosecutor will have to be selected to take over. The decision does not apply to McCloskey's wife, Patricia, who is scheduled to appear before a different judge on Jan. 15.
