Kyle Rittenhouse #2 - Bond Hearing Issue

On February 11th, 2021, Judge Schroeder presided before a preliminary hearing, via Zoom, at the courthouse in Kenosha County, Wisconsin. Kyle Rittenhouse appeared at the hearing with his lawyer, Mark Richards. Also at the hearing was Gaige Grosskreutz (one of the people shot by Rittenhouse), Steve Art (lawyer for the parents of Anthony Huber), John Huber (Anthony’s father), a lawyer for Gaige and the estate of Rosenbaum, and Mr. Binger (representing the state) and ADA Jason Zapf.

“The state had filed a motion,” Mr. Binger stated, “to increase the defendant’s bond by $200,000 and asked the court to issue an arrest warrant for the defendant because he’s violated 969.10, which requires him to upgrade his address with the court within 48 hours of any change of address.”

Early into the hearing, Judge Schroeder asked Mr. Binger what triggered the state to file the motion now. At a previous hearing, Mr. Binger stated he did not believe the defendant was living at the Illinois address, and that he was living in a “safe house.”

“So, I guess my starting issue is,” said the judge, “if this has already been presented and argued before Judge Keating, what triggered the motion now?”

“What specifically triggered it,” Mr. Binger responded, “is the return that the court received. When the court mailed notice to the defendant on December 22nd, indicating that there was an arraignment on this case on January 5th, that was sent to the Anita Terrace address in Antioch, which was the address on record for the defendant. It was returned to the court to your honor on January 28th of this year, indicating that there was no one by that name at that address and they were unable to forward it to Mr. Rittenhouse.”

“My only point, your honor,” Mr. Binger continued, “is that from the defendant’s perspective, what incentive does he have to comply with the bond? What incentive does he have to ensure that the non-monetary conditions are met here? And there is a very small incentive for him to do that when facing charges like this. There’s a very large incentive for him not to comply, not to come back to court. Cause there’s a great risk here he could be spending the rest of his life in prison.”

Mr. Binger felt it was important for the court to know where Kyle Rittenhouse was living. At that time all they had was a P.O. Box number.

“Ultimately your honor,” Mr. Binger continued, “I think this is a case where it would be important for the court to know exactly where the defendant is living. As I said this is an extremely serious case. And I think that it’s important that we don’t know a P.O. Box, we know exactly where the defendant is because of the risk of intimidation to witnesses, the risks to the community.”(12:40)

Mr. Binger’s reasoning for knowing where Kyle Rittenhouse lives is a bit hypocritical in my opinion. Mr. Binger then stated the person who lives at the Anita Terrace address may be in danger. “There is someone new and innocent who is residing there, and should be free from any contact, mail, people bothering them, anything like that.”

This was a clear case of self-defense, in my opinion. You can watch the videos and decide for yourself. The incident happened around 11:45 p.m. on August 25th, 2020, in Kenosha, Wisconsin. Earlier that day, Kyle Rittenhouse was asked why he was in Kenosha. “So, people are getting injured,” Rittenhouse responded, “and our job is to protect this business, and part of my job is to also help people. If there is somebody hurt, I’m running into harm’s way. That’s why I have my rifle because I need to protect myself, obviously. I also have my med kit.”

At least one violent protester attacked Kyle Rittenhouse while he was protecting the business, apparently by himself, around 11:45 p.m. A registered sex offender named Joseph D. Rosenbaum, threw a molotov cocktail or a brick on fire at Kyle Rittenhouse as he fled from a group of protesters. Earlier that same evening, Rosenbaum was caught on film antagonizing armed defenders of private properties. “Shoot me, ni—a,” Rosenbaum shouted.

Rosenbaum was clearly the aggressor in this situation. Rosenbaum’s criminal record is disturbing, especially the sodomy of young boys.

Kyle Rittenhouse was charged with “recklessly” causing “the death of Joseph D. Rosenbaum, under circumstances which show utter disregard for human life.”(Charges Against Rittenhouse pg.1)

That is simply not true, according to video footage of the incident. Rosenbaum threw an object at Kyle and then chased him through the Car Source parking lot.

According to the criminal complaint filed against Rittenhouse, “Following the defendant is Rosenbaum and trailing behind…is a male who was later identified as Richard McGinnis, a reporter. The video shows that as they cross the parking lot, Rosenbaum appears to throw an object at the defendant. The object does not hit the defendant and a second video shows, based on where the object landed, that it was a plastic bag.”

The complaint alleges Rosenbaum threw a plastic bag at Kyle? They fail to mention anything in the bag and the fact that the “bag” was on fire. Rosenbaum was unarmed, chasing an armed man. That’s never a good idea. It also gives us a glimpse into the mentality of Rosenbaum at that time.

As Rosenbaum chases Rittenhouse. “A loud bang is heard on the video,” the complaint continued, “then a male shouts, “Fuck you!”, then Rosembaum appears to continue to approach the defendant and gets in near proximity to the defendant when 4 more loud bangs are heard. Rosenbaum then falls to the ground.”

Kyle then circled back and went to check on Rosenbaum. The reporter, Richard McGinnis then “attempted to ender aid to Rosenbaum.”

Rittenhouse stood there and made a phone call to his friend Dominic Black at 11:46 p.m., “I just killed somebody.” Rittenhouse then left the scene as other people began to crowd around Rosenbaum.(pg.3)

Joseph Rosenbaum’s autopsy was conducted by Deputy Medical Examiner Doug Kelley of the Milwaukee Medical Examiner’s Office. According to the complaint, “Dr. Kelley indicated that Rosenbaum had a gunshot wound to the right groin which fractured his pelvis, a gunshot wound to the back which perforated his right lung and liver, a gunshot wound to the left hand, a superficial gunshot wound to his lateral left thigh, and a graze gunshot wound to the right side of his forehead.”(pg.5)

According to Detective Cepress, McGinnis had interviewed Kyle Rittenhouse earlier. McGinnis and Kyle Rittenhouse then walked “south” together. As they did so, according to what McGinnis told Detective Cepress, “Another armed male who appeared to be in his 30s joined them and said he was there to protect the defendant. McGinnis stated that before the defendant reached the parking lot and ran across it, the had moved from the middle of Sheridan Road to the sidewalk and that is when McGinnis saw a male (Rosenbaum) initially try to engage the defendant. McGinnis stated that as the defendant was walking Rosenbaum was trying to get closer to the defendant.”

So there you have it, Rosenbaum “engaged” and tried “to get closer” to Kyle Rittenhouse.

“When Rosenbaum advanced,” Detective Cepress wrote, “the defendant did a “juke” move and started running.” That is more proof Kyle was trying to get away from Rosenbaum, and only defended himself when necessary.
