For this challenge I had to work wit te driver to take it the distance. Yes Court! I took it to the trial and as an expert witness I got the violation dismissed.
If you win it in court they must remove it from the Inspection. We it stays on but the Out-of-Service and Violation scoring was taken off.

When INTRAstate DOT Rules Apply - Every State's Legal GVWR/GCWR for Intrastate Commerce. ONLY HERE!!
Each State has a specific Gross Vehicle Weight Rating (GVWR) when the D.O.T. Rules Kick In. This information is not easily found, until right now. We have taken the time research this and get this information for you, and it's all right here in this video!
Each state has been confirmed, we are confident this information is 100% correct. Remember, always check with your individual State(s) where you're operating to ensure you are aware of their compliance standards for Intrastate Commerce within that State.
For Intrastate Commerce, each state has their individual rule as too when a vehicle becomes a Commercial Motor Vehicle. There are 23 states who require DOT Compliance for Non-CDL Drivers while operating in Intrastate Commerce within their state.
Remember all INTERSTATE Commerce begins at 10,001 pounds GVWR/GCWR for Property Carrying Vehicles.

Using a VIN Decoder to Find a Vehicles GVWR! Great tool for Fleet Managers and Compliance Tracking!
PRO TIP for D.O.T. Compliance Professionals. This tool is what enforcement officers and safety investigators use when they don't have the vehicle near by to check the official VIN label for the Gross Vehicle Weight Rating (GVWR).
In your Fleet Tracking spreadsheets you should always document the GVWR. It' absolutely important to know these weights for safety and compliance. Especially, when using pickups and trailers that are close to the CDL requirements.
This tool will give you the VIN's GVWR Range. Usually the actual GVWR is at the top of the range. But there are curtain instances when a lower range may be used.
So if your vehicle is out in the field and you are struggling to get the weights, this tool will help you out, until you're able to get the actual number off the vehicle VIN label.
This tool works great for all power units. It's not as great for the trailers, but it's a good starting point!!

CMV ROAD TEST, How to complete and Who must have the test. Start your drivers off right - On Day 1!!
Companies using Non-CDL and CLD Drivers must do a road test to ensure the driver applicant is qualified. How else do you really know if they can actually drive the types of vehicle you have in your company.

Complete your MCS-150 Update quick and easy!! Don't get scammed follow these easy steps for success!
The biggest scam in the DOT world is the Biannual Update to the UDSOT Number. Stop the Spammer Scammers in their tracks, because this video will teach you how to complete the update FREE. The Scammers will charge you up to $600 to complete. It's super easy and definitely not worth a cost of $200-$600.
Not doing your update can result in fines from the FMCSA for up to $10,000 and failing to do this could cause the USDOT number to become Suspended and result in a DOT Compliance Investigation. If this were to happen then your trucks and drivers would get placed Out-of-Service when stopped at weigh stations, inspection checkpoints, or pulled over by a state trooper.

FMCSA PIN Number - How to Reset or Request so you can Update your MCS-150 (USDOT Number) or Portal
Scammers are constantly calling, texting, emailing, and snail mailing to get you to update your MCS-150 the USDOT Number Application. They even threaten you with extreme fines trying to convince you that you're in trouble. Then they'll charge you up to $600 to do the update. OUCH! It takes like five minutes. I'll upload that video next!!
DO NOT GIVE OUT YOUR FMCSA PIN. Unless it is a trusted business relationship such as my Company "Front Range Compliance Services LLC" has with our clients.
If the wrong person has your FMCSA PIN they can change, adjust, or highjack your USDOT Number.
Getting your PIN either recovered or reset has never been easier. As long as the Federal Motor Carrier Safety Administration (FMCSA) has the correct email or cell phone. If either the email or cell is incorrect, then the PIN number will have to be mailed though the good old fashioned Snail Mail.
The envelope will be clearly from the FMCSA with their circular logo. DO NOT TOSS IT OUT as it is often confused with other junk mail.

FMCSA Clearinghouse - Annual Queries are DUE NOW - What you Must Do Now for your CDL Drivers!!
For all CDL drivers you were employing on January 6, 2020, and are still employing today, you MUST NOW complete the Limited Annual Query in the FMCSA Clearinghouse. This must be done on or before January 5th, 2021.

FMCSA Clearinghouse Explained - The Info you must know when employing CDL Drivers.
The FMCSA Clearinghouse went live almost a year ago (January 6, 2020) and many companies are still struggling with the requirements and still have not registered or completed the required Queries that were needed for 2020.
Queries:
Pre-Employment Full Query - must be completed first to check for if drivers applicant is registered and if he/she has any prohibitions/violations.

The most misunderstood and misinterpreted regulations of all the general transportation rule. The Federal Motor Carrier Safety Administration (FMCSA) has done a little bit of a correction to the 2005/2013 HOS Rules. This might actually make life a little easier. Especially if you are using the local driver exception because you can now work 14 hours and not have to worry about a logbook or ELD.
