HEARING: Will Alec Baldwin's Indictment Be Dismissed?
Yesterday Judge Mary Marlowe Sommer, presiding over the upcoming manslaughter trial of Alec Baldwin, for the killing of cinematographer Halyna Hutchins on the set of low-budget western movie "Rust," held a hearing to resolve a motion by Baldwin's highly paid defense team asking that the grand jury indictment against their client be dismissed.
Arguing counter to that defense motion is prosecutor Kari T. Morrissey. Morriseey also prosecuted the manslaughter charges against "Rust" armorer Hannah Gutierrez, whose trial was also presided over by Judge Sommer. Gutierrez was found guilty of involuntary manslaughter, and sentenced to the maximum of 18 months by Judge Sommer.
The Baldwin defense team has filed several motions demanding that his indictment be dismissed, largely on grounds that seem spurious. Nevertheless, they are being highly paid to advocate zealously for their client, and this challenge of the indictment is part of that defense.
Yesterday Judge Morrow finally heard the oral arguments of the parties, as a final step before she issues a ruling on the defense motion to dismiss the grand jury indictment--and THAT'S what we'll be covering in today's show.

REAL LAWYER | Daniel Perry Pardoned! Justice? Or Fascism?
Yesterday, May 16, Texas Governor Greg Abbott issued a full and complete pardon to Daniel Perry, on the recommendation of the Texas Board of Pardons and Paroles.
Perry had been convicted of the murder of AK-47 armed Black Lives Matter protestor Garrett Foster during a 2020 BLM protest in Austin TX. The jury rejected Perry's claim of self-defense, and Perry was subsequently sentenced to 25 years in prison.
Although Gov. Abbott had soon after the trial promised to pardon Perry if the Board of Pardons so recommended, I'd personally expressed some skepticism that a pardon would ever actually issue--not for legal reasons, but for political reasons.
Now that a pardon has issued, the firestorm of outrage over this case has re-ignited. Is the Governor's pardon a lawless genuflection to racist fascism, as the Progressive Left claims?
Or is the pardon simple justice for an American serviceman who was merely exercising his Second Amend right to bear arms and his legal privilege of self-defense, and whose conviction was itself unjust?
Join me LIVE at 11 AM ET for a REAL LAWYER take on this controversial use-of-force event, trial, and pardon!

Sound Legal Analysis, or Shameful Misinformation?
Two days ago, Attorney William Kirk, the President of law firm Washington Gun Law, released a YouTube video on his extremely popular channel (~360,000 subscribers) providing legal analysis of the tragic shooting death of Roger Fortson.
The title of that video: "The Florida Man Who Was Executed for Exercising His Constitutional Rights." (Find it here: https://youtu.be/IWepSw11YiA?si=_mxXsCsqGFyz5yGQ)
Given that this analysis was by a fellow attorney popular with the gun community, I eagerly looked forward to his analysis.
It was, to say the least, disappointing. Indeed, a good case can be made that the video not only failed to provide anything resembling sound legal analysis, it was rife with emotionally-laden misinformation.
Indeed, the video makes zero--as in zip, zilch, none--reference to any relevant Florida law that would determine if Fortson's shooting was legally justified. Not a word.
In my opinion, criminal defense lawyers in particular should do better when covering such high-profile, emotionally-charged use-of-force events.
Join me for my own take on Attorney Kirk's "analysis" of the Fortson shooting, live at 11 AM ET.

REAL LAWYER | The Roger Fortson Shooting: Awful? Lawful? Both?
On Friday, May 3 a Florida deputy responded to a domestic violence call. Arriving at the apartment complex the deputy was met by the woman who'd made the call, who directed him to apartment 1401, in which she believed the violence to be occurring.
The deputy knocked on the door, standing on either side for purposes of safety. When the door opened, the deputy was presented with a man with a gun plainly visible in his hand.
The deputy immediately drew his service pistol and shot the man, killing him.
That man would turn out to be Roger Fortson, a US Airman who was not, in fact, involved in a domestic violence event, and who by all accounts was doing nothing illegal at all when fatally shot by the deputy.
Fueled by the usual lies of race baiter Benjamin Crump, as well as by visions of how the world might be if perfect, the internet is hysterical with outrage.
Could this tragic shooting nevertheless be lawful? Is it necessarily murder? Manslaughter? Or is it simply not a crime at all under the law of self-defense?
Join me LIVE at 11 AM for an EMOTION-LESS, LAW-BASED analysis of the police shooting of Roger Fortson.

Fortunately, you've prepared for this fateful day, and are armed for a deadly force encounter--with a hand grenade. You pull the pin, toss the frag, and BOOM! Problem solved!

Even less clear--what if your hand grenade also kills or woulds innocent bystanders? Can THAT possibly be lawful?

Dangers of Coming to the Defense of Others
Suddenly you see another person being threatened with physical violence.
You have the means and opportunity to come to their defense.
Should you? Are you aware of the very real risks you're incurring if you do so--risks of death and life in prison? Have you thought through the scenarios in which you're willing to incur those risks? For yourself? For your wife and children and others you have a duty to support?
Today we discuss these questions in the specific context of a tragic defense of others event that just recently occurred, as well as in a more general sense.

But what about the use of force in defense against ANIMALS?
The rules of engagement are not at all the same when defending against animals rather than people.

8 COPS SHOT, 4 KILLED : Real Lawyer Analysis!
On Monday, April 29, 2024, around 1:30 p.m., the U.S. Marshals Fugitive Task Force was attempting to serve active felony warrants for unlawful felon gun possession and felony flight to elude on 39-year-old convict Terry Clark Hughes, Jr.
As officers approached, Hughes began firing at them, striking multiple officers. The officers responded in kind, and the gunfight was on.
By the time the smoke cleared, Hughes was dead. Unfortunately, eight of the officers involved had been short, four of them fatally.
Today we'll take a look at a variety of legal questions that arise from these kinds of engagements including: Is the suspect's home the safest place to secure their arrest? Can it ever be lawful to shoot at police? Should a felon who has served their time regain their gun rights? And much more!
We'll also, of course, take Q&A from our Law of Self Defense Members.

VIDEO! The Deadly Limits on Open Carry!
An Ohio police officer responds to a call of a man walking around a residential neighborhood pointing a gun at homes.
As the officer pulls up, he sees a suspect that matches the description called in.
The officer begins to verbally engage with the suspect--and within seconds has fired a shot as he spots an apparent gun in the suspect's hand. The apparent gun would later be determined to be a toy.
Ohio happens to be an Open Carry state, meaning it is lawful to openly carry a firearm in public.
Does that make this officer's shooting of this suspect unlawful? What if it is determined that the suspect had only the most innocent of intentions in possessing that apparent gun.
Join me LIVE at Noon ET to discuss the video of this shooting!

Real Lawyer: What Went Wrong in Work Truck Shooting?
Shocking video has been released showing a North Carolina Department of Transportation worker attempting to use a pistol to prevent the theft of his work truck.
He fires several rounds at the thief, who manages to drive the truck away backwards.
Unfortunately, the thief then drives the truck back to the scene of conflict, running down and killing the NC DOT worker.
The thief has now been charged with murder, larceny of a vehicle, and other crimes--but, of course, the NC DOT worker remains dead.
What went wrong in this tragic scenario? What were the legal errors, if any? What were the tactical errors, if any?

Thieves Steal Car On Camera, Shouting at Owner to Not Come Out of Home
Watch as a shocking incident unfolds in San Jose, CA, where a group of brazen car thieves steal a Corvette in plain sight of security cameras, knowing they are being filmed, while threatening the owner's life if he attempts to prevent the theft.
Should such thieves threatening deadly force to complete their crime themselves be at jeopardy of deadly defensive force by the property owner? Could it possibly be lawful for an armed property owner to simply shoot down such thieves to protect his property?
If so, is this a case of the owner valuing his property over the lives of the thieves, or rather a case of the thieves valuing someone else's property more than they do their own lives?
Join this LIVE debate on whether it should be legal for individuals to use deadly force to protect their personal property in situations like this. Share your thoughts on this alarming scenario and the implications it raises for personal safety and property rights.

LIVE! Prosecution SLAPS DOWN Baldwin Defense! (3/3)
In today's show I do a LIVE reading of the Prosecutor's SPICY response to Alec Baldwin's lame attempt to get his manslaughter indictment dismissed!
I covered the the defense motion to dismiss the indictment in two shows over this past weekend, and it's probably best to view that first for best context:
Part 1: https://youtube.com/live/pI0Yw2_Ww3E
Part 2: https://youtube.com/live/tJ7qca0z2ic
Almost exactly one month ago (March 14), Alec Baldwin's legal team submitted a motion to their client's manslaughter trial court to have the grand jury indictment against Baldwin dismissed.
The motion makes many claims of misconduct against the prosecution, and particularly emphasizes the failure of the prosecution to present substantial exculpatory evidence to the grand jury.
Just about a week ago (April 5), Special Prosecutor Kari Morrissey filed her response motion--and it is ON FIRE!

VERDICT WATCH | Apple River Stabbing Trial (Part 9)
In today's Part 9 we're on verdict watch, waiting to see if the jury will return a verdict of guilty--with a life sentence for 52-year-old Nicolae Miu--or not guilty based on self-defense, or perhaps a mistrial.
On July 30, 2022, Wisconsin-man Nicolae Miu got into a confrontation with several other tubers on the Apple river. He would end up stabbing five people, killing one--17-year-old Isaac Shuman. Miu is now charged with murder, and his trial began this past Monday.
He is raising the legal defense of self-defense.
