Hate Crime Laws only A Tyrant could Love: Bill C-63, the Online Harms Act
In this video, I tear apart Bill C-63, the so-called Canadian Online Harms Act, which is little more than a thinly veiled piece of tyranny designed to suppress political opposition, political debate and the spread of ideas the Trudeau government doesn't like. I look at the Orwellian legislation that if passed could put you in jail for a pre-crime, something you might do in the future, if someone who doesn't like you files a complaint. The penalty for words the government doesn't like can now be life in prison. I then look at the proud tradition of public attacks on tyranny in the form of a vicious speech called a Philippic, named after Demosthenes attack on Phillip II of Macedon and picked up by the Roman jurist Cicero in his attacks on Mark Anthony. The tradition of democratic and republican government in the West hinges on the ability to attack tyranny, or engage in any serious debate, without fear of offending. Hate crimes are tools of tyrants. The notion that hate is a social evil is folly, and will kill civic life in the West.

Although the Federal Court declared the proclamation, regulation and order ultra vires, and parts of the regulation contrary to the Charter of Freedoms, the TRUTH IS THE DECISION is a road map to greater state power and a how-to manual to crush future protests. Blade Runner 2049 --- Film Review
For those who didn’t know, Blade Runner 2049 is a sequel to the 1982 science fiction film directed by Ridley Scott set in a dystopian future Los Angeles of 2019, in which synthetic humans known as replicants are bio-engineered by the powerful Tyrell Corporation to work on space colonies. When a fugitive group of advanced replicants led by Roy Batty escapes back to Earth, burnt-out cop Rick Deckard reluctantly agrees to hunt them down. The sequel tells us much more about the world of 2017 (when it was made) or 2023 than about the future. The movie 2049 really has nothing to say about anything, but its surfaces tell us everything about ourselves, our civilization, our declining virtues and esthetics and a theatre on its lasts legs. This film review is therefore entirely "superficial", but in looking at the messaging, we are seeing the only thing of lasting value in this film.

Weber, Authority and the Coming Storm (Episode 3)
From dawn of civilization, Man has understood the iron ties between Law and Force. Critical to understand force is to know who has legitimate Authority to rule and use the Coercion of the state to enforce that Authority. In this episode we look at Authority through the genius of Max Weber, who identified three pure types of legitimate authority: 1. Bureaucratic; 2. Traditional; and 3. Charismatic. Weber also predicted the relentless machine of modernization within capitalism and its endless drive to rationalize and systematize all aspects of the human society, down to identity itself, pushing religion, mysticism and even magic aside. The result he also predicted was disenchantment and despair. The answer may be the rise of charismatic personalities who can save society from a soulless machine and man from this pit of monotony and enslavement. But the machine may have a trick up its sleave. Rather than wait to be replaced by the GREAT MAN, the regime seems to have evolved a third form of authority, the 4. Impersonal Charismatic. Driven by the irrational, by power over profit, institutions of the state and their private agents, the corporations, both using vehicles like Woke capitalism hypnotize the population into belief that the institutions and corporations are the source of magic, with extraordinary capacity for holiness and goodness, and wildly charismatic, putting out fake charismatic leaders, who are merely agents of the regime while snuffing out the rise of any true exceptional personal talents in the population. When it feels safe, if we allow that to happy, the bureaucracy will return to routine and impersonal rule.

Law is one of those institutions central to the moral, social and even spiritual nature of man, and yet throughout history, some our greatest thinkers and poets have asked, Is law even Necessary? Enlightened Despot, a jurist extra-ordinaire, looks to the classic text of Dennis Lloyd, "The Idea of Law" for some insights. Is law a repressive evil, as Plato or Marx thought, or is it a positive social necessity ... as thinkers from Seneca to modern times have contemplated... to counter man's inherent or acquired evil under control? Today you can ask if we have enough empirically evidence that taking the "lid off" social restraints has proved the pessimists about human nature right.

Lex Cast: The Enforcement of Morals (Episode 2)
Perhaps never in human history has the relationship between law and morality been more important. And yet the relationship is far from simple. There is no question that one of the sources of law’s legitimacy and authority is the belief in our moral obligation to obey the law. Our ancestors saw law as having divine origins. That may obedience easier, as Orestes can tell you. Some laws could be traced directly to God, like the 10 Commandments. Other laws were treated as divinely inspired. Lawgivers in anciety times were often treated as semi mythical or semi divine or heroic figures. In the video, we look at the law and morality as understood by our ancestors, how the ancient Greeks introduced the notion of a rational order to the universe, governed by intelligible laws ascertainable by rational investigation and, and in the process, succeeded in partialy decoupling human law from divine law. The video addressed the moral obligation to obey even human law, illustrated by trial of Socrates culminating in the Wolfenden Report in 1957 that recommend that the laws get out of the bedrooms of the nation. We look at the famous Hart-Devlin debate on whether certain same sex sexual practices should be decriminalized. Finally, we look at how Lord Devlin's argument that the state must protect private morality, even where there is no harm to others, for the good of society as a whole and to protect the vulnerable, and how the failure to head his warning is playing out today.

Legal Realism: Practice makes Imperfect (Episode 8)
Last time, we looked at how legal positivism in its reformist zeal declared that the only source of the law is the state, and how this ended up centralizing power like never before with an ongoing tendency to authoritarianism. The Legal Realists saw the real power, not in the legislature, but in the judges who interpreted the law. One of the first and greatest of the legal realists was OIiver Wendell Holmes, Jr. He was an associate US Supreme Court justice until he was 90 years old. Holmes did not believe the law was rational or logical. He rejected natural law theory as fairy tales. To him, law existed only in action, in the courts, and had to be studied as to how it actually worked without sentimentality. Legal Realism arises out of American pragmatism after WWI, a cold soulless philosophy Williams James called the "Bitch Goddess of Success". What Ho#jurisprudence #olivelmes should have had the wisdom to foresee was that by kicking open the door to law as a technical skill only, detached from morality, he set the stage for Critical Legal Studies, closely tied to Critical Race theory, and to progressive activist courts which see law as merely about power and politics. Legal Realism can be seen everywhere today, in Trump being struck from the ballot in Colorado, to the conviction of the innocent for the crime of having the wrong skin colour or political point of view or not wanting to fly a rainbow flag. Holmes was also famous for his views on Eugenics, reflected in the case law, a pragmatism we see today in places like Canada where 50,000 have been Euthanized since 2000. We are a long way from Natural law and the pursuit of the good, the true, and the just.

Halloween III Season of the Witch -- Cult Film Movie Review
The third installment of the Halloween series received terrible reviews, but has become a cult classic. John Carpenter broke the mold of the first two slasher films to create a tale of the witches' revenge, a plot by the Celtic Druids to pull off the biggest practical joke in the world ... on the children... using masks, television.... and consumerism. and of course the cooperation of mass media. The tale resonates in 2021, as the globalists seek a return to worship of mother Earth...
