ATV & Motocross Park At The Livingston California Domestic Wastewater Treatment Plant- 13 Questions
A Post Appeared Recently on the Livingston Community News About An ATV Park on a Section of Land At the Livingston California Domestic Wastewater Treatment Plant Facility.
According to video of the 02/01/2022 City Council Meeting A Test “Pilot Program” Had Already Taken Place And That It Was A One Time, One Weekend Only Use,
And That, because it was an “exploratory Program” There Was No Written Agreement Governing The Terms of Use and Liability
Here are 13 Questions that should probably be answered
1) Will it be Operated by the City?
2) Will it be Maintained by the City
3)Will it be open to All Residents of the City?
4) Will it be open to people who reside outside of the City Limits?
5)Will there be a fee for use of the ATV/Motocross Recreational Area on a Daily, Weekly, Monthly, or Annual Basis?
6) If there is an Admission Fee, would this revenue be used to Reimburse the Waste Water Capital Fund for the use of the land paid for by the Residents of Livingston through their Sewer Bill?
7) Would Admission to the ATV/Motocross Recreational Area require the signing of a Waiver of Liability holding the City harmless?
8)If the General Public will not be allowed access to the Recreational Area, Then will the group/organization/people using the land be required to lease the land on a Daily, Weekly, Monthly, or Annual Basis?
9)If there is a Lease Agreement, will the Revenue from the Lease be used to Reimburse the Waste Water Capital Fund for the use of the land paid for by the Residents of Livingston through their Sewer Bill?
10) Will the land involved revert to it's original state and be available as a Sewer Pond when needed by the City due to future population growth?
11) Who would be responsible to return the land to the way it was before being occupied by an ATV Motocross Recreational Area?
12)Is a sale of land at the Domestic Waste Water Treatment under consideration?
13) If a sale of land is being considered, would the proceeds be used to reimburse the Water Capital Fund for the cost of the land paid for by Residents of Livingston through their Sewer Bill?
