From the beginning, Elizabeth Holmes knew how to tell a good story. She launched her blood-testing company, Theranos, with a tale of a powerful vision to revolutionize health care and change an old, outdated industry. She presented herself as Steve Jobs, part two. She sketched out a picture of someone in control. That Holmes, and that story, is what prosecutor John Bostic worked to reset back to during his rebuttal argument, the last word before the case went to the jury on Friday afternoon. It wasn’t reasonable to think the CEO of a company didn’t know exactly what impression she was giving to investors, Bostic said. It was clear she knew about problems with the Theranos tests. Holmes knew that the technology wasn’t working as intended and that Theranos might not be able to change the world. When that story started to fall apart, she tried anything she could to try and keep it together. “We admire people who set ambitious goals and set out to achieve them,” Bostic said. “Instead, we see a CEO of a company so desperate for success, so afraid of failure, that she was willing to do anything to keep that company from failing.” But in the closing arguments of her trial for fraud, which wrapped up Friday, her defense attorney Kevin Downey also told a story. This story was about a well-meaning CEO who trusted what experts told her, who didn’t know about problems at her company, and who couldn’t be faulted if people misinterpreted the things she told them about Theranos. It relied on undercutting the origin story in order to convince the jury that she wasn’t guilty of the charges against her. To find her guilty of those charges — wire fraud and conspiracy to commit wire fraud — the jury has to believe Holmes intended to give people misleading information about what the Theranos technology could do. That intent matters, Downey stressed through his closing arguments. Figuring out that intently takes getting inside Holmes’ head during the times she lied or said things that could be misleading. When Holmes told investors and reporters that the Theranos devices could run hundreds of accurate tests, Downey said she actually was referring to what the company was going to be able to do in the future, on future iterations of the Theranos device. And when Holmes told investor Bryan Tolbert, vice president of finance for Texas-based Hall Group, that the company was “doing a lot of work” with the military, she didn’t mean that Theranos devices were actively in use in the military — just that the company was working towards that goal. (Investors say Holmes told them the company’s devices were used in Afghanistan and on medevacs.) If investors got the wrong idea, well, that was because they misinterpreted things, Downey said. And, even if they did misinterpret things, that didn’t actually matter, he said. Those types of statements from Holmes weren’t why investors decided to give Theranos money. Holmes and the things she said weren’t actually that critical to the decision-making process, Downey said. Investors just cared that Theranos had a partnership with Walgreens. (Multiple investors said they trusted the stories Holmes told them about Theranos’ capabilities.) Holmes also couldn’t be responsible for any problems with the Theranos technology, Downey said. Other people were responsible — like former Theranos lab director Adam Rosendorff. Holmes thought the tests were accurate. She saw positive reviews from satisfied customers, and the company apologized any time there was an error. She had no reason to think there were any issues that she needed to be concerned about, Downey said. (In fact, Theranos’ scientists repeatedly flagged serious issues to Holmes in emails revealed throughout the trial.) Holmes didn’t behave like someone who had something to hide, Downey said. She hired a high-profile board of directors — a former secretary of state, a former senator, a retired Marine Corps four-star general. She allowed people from drug companies and academic institutions to scrutinize her company’s tech. She gave information to the Food and Drug Administration. And, when news reports and a federal investigation found problems with her labs, she doubled down on work to figure out what went wrong. “You know that at the first sign of trouble, crooks cash out, criminals cover-up, and rats flee a sinking ship,” Downey said. But Holmes was a devoted CEO who believed that her company was going to change the world. Instead of running, she brought in experts to scrutinize the testing program, Downey noted. “Are those the actions of someone who had been engaged in a conspiracy to defraud people?” There are versions of Holmes everywhere: there’s the one she offered in media interviews, the ones sketched out in podcasts, the one that will be fictionalized in the upcoming Hulu series. Over the past three months, there have been two more, presented by prosecutors and defense attorneys. Now, those versions go to the jurors. It’s up to them to decide which story is the closest to reality — and if that reality is criminal. Just days after New York City Mayor Bill de Blasio announced a vaccine mandate for employees of private schools — including religious schools — a major Hasidic leader in Israel has instructed his followers in Brooklyn to comply with the mandate. Rabbi Yissachar Dov Rokeach, the leader of the Belz Hasidic sect who lives in Israel, urged teachers at a new Belz school being built in Borough Park to get vaccinated. “In the matter of vaccinations against Corona, indeed, it is proper for all staff members to be vaccinated — the men as well as the women, and may it be with great hatzlacha [success,]” Rokeach wrote in a letter, according to local news site BoroPark24. Rokeach’s instructions for his followers regarding the coronavirus pandemic have at times been contrary to government guidance. Last October, Rokeach refused to close his yeshivas and urged students to continue studying in spite of orders from the government to shut down to slow the spread of disease. Still, Rokeach has come out in favor of vaccines. Earlier this year, a coronavirus vaccine drive was held at the main Belz beit midrash or study house where about 1,500 people were vaccinated, according to Yeshiva World News. She looked at her father, her father tried to rush to the TV, and the remote to turn off, and she said, 'Shame on you, father! Shame on you!' and then she went back into her room. And so that man, after turning off the TV...those words resonated in his head, 'Shame on you, father! Shame on you!' And tears started coming down his eyes, and he stayed up until fajr...crying. Then he went to the masjid and he prayed with the congregation, and he was crying so profusely. Some of the brothers who had not seen him at fajr prayer, said, 'Are you okay brother?' He says, 'I'm okay.' One of his close friends came to him, he says, 'Are you okay?' He's crying and he says, 'For over 20 years...for 20 years, this was my first sujood for Allah (subahaanahu wa ta'ala).' Because of his daughter! His daughter came on and said, 'Shame on you!' So he went to work that morning, and of course, he was very tired because he didn't get much sleep at night. His wife tried to call him but she couldn't reach him. He came home and she said, 'Honey, our daughter just passed away.' His daughter passed away. And those words again came, the last words that she heard were, 'Shame on you, father! Shame on you!' The whole day...those were her last words, 'Shame on you!' So he went and he buried her, and he put her in the grave. When he put her in he smiled, then his friend looked at him and said, 'Why are you smiling?' And he'd been crying so much, now he puts his daughter in the grave and he smiles. He says, 'I've buried my daughter, but she left a Noor (light) that will remain in my heart, Allah willing, until the day of judgment.' And from that time on, he became strong and he kept on going to the masjid. And he changed! Allah took away something from him, but because of those words from his daughter, he became good again. In late august of 2021, I went on a journey that would change my life forever. It was my first ever solo trip as well as my first overnight wild camping experience. I spent 2 weeks hiking through the Alps of Switzerland, going up and down every day, swimming in freezing waters, and setting up my tent in the most surreal locations I could ever imagine, in total covering more than 100 miles. Safe to say that this trip meant a lot to me and I can't wait to hit the trail again. When it came to editing this video it was no easy task especially when you have 7 hours of footage, the first 2 weeks I spent just thinking about which clip to put first in the timeline, I knew what kind of a video I wanted and I did a lot of planning but despite that, it still felt like a black piece of paper, now almost 1 and a half months later I'm finally happy with it and I'm super stoked to show it to your here on youtube, any feedback whether positive or negative will be greatly appreciated and if you could share this video amongst your friends and followers it would mean the world to me. if you have any questions about the film, the shooting or editing process, or my hiking experience feel free to ask in the comments which I will cover in an upcoming behind the scenes video Cheers Music and SFX are used from Artlist.
